Terms of Service

These Terms of Service (“Terms”) govern your use of activated.cloud and any related services operated by Inafield (Pty) Ltd (“Inafield,” “we,” “us”). The Activated Cloud is currently available for preorder only and has not yet shipped. By placing a preorder or using our website you agree to be bound by these Terms. If you do not agree, do not use our services.

When you reserve an Activated Cloud, a $50 non-refundable deposit is charged immediately through our payment processor. This deposit reserves your unit at its preorder price. We currently estimate shipping to begin in 2027, but this date is not guaranteed and may change.

Before your Activated Cloud ships, we will email you to confirm your shipping address and final total. You will have 7 days to adjust your order before we charge the remaining balance (the device price minus your deposit), applicable tax, and $15 flat shipping per unit, worldwide. The flat shipping rate applies to every destination; for international orders, carrier import duties or customs fees may be due on delivery.

An order secures your place in our production queue and locks in the preorder price. During checkout, we also collect your shipping address so we can calculate applicable tax and confirm your final total when production is complete.

Before your Activated Cloud ships

The deposit secures your place in the production queue and is non-refundable. You may still update or cancel your order by emailing us at the address listed below before the remaining balance is charged; cancelling releases you from the balance, but the deposit is not returned. If the estimated ship date changes by more than 6 months from the date shown at the time of your order, we will notify preorder customers of the updated timing.

After delivery

You may return your Activated Cloud within 14 days of delivery. The device must be in its original condition and packaging. Shipping costs for returns are the responsibility of the buyer, and a 15% restocking fee will be deducted from your refund. After 14 days, all sales are final.

The Activated Cloud is a dedicated hardware device designed to run always-on AI agents. The planned configuration includes Activated Cloud OS pre-installed, a hardened Linux build, 8 GB RAM, 128 GB SSD, and an NFC chip for phone pairing. Because the Activated Cloud is in preorder and not yet in production, hardware specifications, included software, and features may change before the final unit ships. We will notify preorder customers of any material changes.

The Activated Cloud is a general-purpose Linux computer. While it is optimized for running AI agents, you are free to use it for any lawful purpose. Nothing is locked down.

Activated Cloud OS is a planned companion app that will provide messaging, integrations, and observability for agents running on your Activated Cloud. It is currently in development and is not yet available. Use of the app will not be required to operate the hardware.

When Activated Cloud OS launches, we anticipate the following pricing structure:

• Usage-based: LLM costs are passed through at our current margin, which we may adjust with at least 30 days’ notice.
• Bring your own keys: If you supply your own API keys, app access is free.

This pricing is projected and may change before launch. Once Activated Cloud OS is available, we will provide at least 30 days’ notice before any pricing changes.

You agree not to use the Activated Cloud or Activated Cloud OS to:

• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Distribute malware, spam, or engage in phishing
• Harass, threaten, or harm any individual
• Attempt to gain unauthorized access to any system or network

We reserve the right to suspend or terminate access to Activated Cloud OS services for violations of this policy. The hardware itself remains yours regardless.

To the maximum extent permitted by law, Inafield shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Activated Cloud or Activated Cloud OS.

Our total liability for any claim arising from these Terms or your use of our products shall not exceed the amount you paid to us in the twelve months preceding the claim.

The Activated Cloud runs software including Activated Cloud OS and cloud-based LLM services. We are not responsible for the actions, outputs, or failures of AI agents you deploy, nor for the availability or performance of third-party APIs and services.

The Activated Cloud is offered as a preorder product. We make no warranty, express or implied, regarding the final production timeline, specifications, or fitness for a particular purpose until the product has shipped. Preorder customers assume the risk that the final product may differ from current descriptions.

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Sandton City, Johannesburg, South Africa.

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
